How Might the Age of the Injured Person Affect An Auto Accident Injury Case Outcome?

Situation:
How Might the Age of the Injured Person Affect An Auto Accident Injury Case Outcome?

Our client, an 82 year old woman, was struck crossing a street by a car attempting to turn right on a red light. The driver of the car, age 22, did not see our client in the cross walk as she was looking to her left to view oncoming traffic, while our client was walking from the driver’s right side. Contact occurred at a very low speed, 2-3 mph. Injury consisted of a tibial plateau fracture, one of the bones in the knee. Surgery occurred the next day, consisting of placing a plate and screws into our client’s lower leg. After a week in the hospital, she was discharged to a rehabilitation facility, as she could not walk.

Prior to the auto accident, despite her age, our client had lived independently, without any help in the house. Following release from the rehab center, she returned home and made good progress. Over the next year, she developed some pain where the hardware had been placed in her leg. This was subsequently removed. Following this, our client made an exceptional recovery.

Successful Resolution: $250,000

The driver’s insurance company originally offered $150,000 to settle the case. We advised our client that this sum was inadequate. Suit was filed and the case placed on a quick track for trial. In Illinois, an injured person age 70 or older can petition the court to advance a case for trial, which is a year or two earlier than the case would regularly be assigned. Facing trial, the insurance company raised its offer to $200,000, then $250,000, which our client agreed to accept.
